The judge didn't even care to hear the case, so that tells you how much leg this case had to stand on.
The principle isn't about what's legal. There are so many underhanded, outlandish things that are done within or outside but allowed by the law.

The question is: do the Ferentzs have character?
 
Not sure why this is on a football forum, other than someone witch hunting KF but I'm bored so I'll participate in the conversation ( going to stay out of the high school girls locker room drama). As a side note how stupid do you have to be to think that just because you have means and crapped out a couple of kids your neighbors are obligated to care about them. If you want your children to have a place to ride their bikes, maybe you should of bought a house with that in mind.
The character of KF (and this being the reason why he's a good coach (can't be because he's a winner, he's a maintainer)) which is brought up many times on this board. Can those 'good character' posts cease and desist, as well, please?

But the question to me is: Do the Buatti's have character?

Seems to me he's the one trying to scam people into paying for the road he wants paved. The Ferentz's initially agreed to help pay for repairs to the "gravel" road. They were fine with that. All of a sudden Buatti (who is a Radiologist who appears well off) decides behind the Ferentz's back to hire a guy to redo the road with some kind of hard coverage. This so he probably can sell his divided lots better. He then decides to con everyone into this HOA so that he can leverage what he wants. Ferentz's were never a part of the HOA so aren't bound to them. Also, they aren't bound to pay for or maintain the paved road. They initially only agreed to help maintenance to the gravel road which they wanted to keep.

In addition, the Buatti's have this lame excuse or reasoning that they wanted the paved road so their children can bike on it. Heck, their children are pretty much 18 and older and may all be out of the house. It isn't like they are 7 yrs old. Might have been when this all started I guess.

I think the guy wanted the road paved to help sell his lots, IMO and wanted everyone to help pay for it since they use it as well. But, he had his own agenda, IMO. I just think there is something shady about the guy myself.

So yes, I think the Ferentz's have character. They just want their privacy and the feeling of living in a rural setting. Nothing wrong with that. They shouldn't have to give in, even though Kirk is most highly paid Iowa employee. I have a problem with the action of the Buatti's and them pushing their agenda behind people's backs. That to me is low character.

I thought the exact same thing as you. Sounded like this Buatti wanted to sell lots for development and the Ferentz's didn't want that and objected to it. Now they're trying to use the courts and the press to bully Ferentz's into agreeing to things they don't want to.

If I'm Ferentz and I bought land out in the country for privacy and my neighbor wanted to pave the road and sell off lots to create a new residential development I'd be pretty pissed too.

This whole thing is pretty stupid and reeks of rich white people problems.

Not that it has anything to do with this but maybe that is what Mary meant when she stated "You don't understand who I am...". and maybe referring to the privacy they want. I don't know. She may not have even stated that to the guy for all we know.

The entire thing is stupid and I don't see the Ferentz's on the hook for anything, with my limited knowledge about law. Once Buatti had that guy lay whatever surface over the gravel, he pretty much voided any kind of agreement or contract the Ferentz's agreed to. Probably did it when the family was gone to a bowl game or something. I'm sure the minute that happen, the Ferentz's were pizzed and decided they aren't working with them anymore. This then pizzed Buatti off as now he can't push his agenda and the Ferentz's look standoffish. Then became a pizz match between the two.

I also thought it was funny that they claimed they wanted to pave the road for their kids safety. A paved road and more houses means more cars. More cars equals greater chance of your kids being hit by cars.

Yes, Kirk is a monster for forcing kids to bike on a gravel road, and for telling an intrusive neighbor with no legal grounds to get bent.
 
There has been massive drama with my HOA. Our building has some water issues. $2.3 million is what an engineering firm told us it would cost to fix. Board approved the special assessment. But over half the people in the building don't have the cash to pay, so they voted it down in a member meeting. The competent people on the board resigned and the meeting to elect a new board was about 10x as confrontational as the 2016 presidential election.

The ringleader of "the resistance" is some post Wall alpha widow who is trying to sell her place and thinks that if the special assessment gets killed she won't have to pay it. The financials for the association say in bold and all caps right on page 1 "The Balance Sheet does not include any liability for the contemplated $4 million special assessment to repair water leakage issues" or something similar. I asked this woman if she thinks she is better off with that $4 million line item or just letting the $2.3 million assessment happen and she literally cannot comprehend the issue - she thinks the $4 million line item has absolutely no bearing on her ability to sell and doesn't realize that bince she owns about 1% of the building, she has to escrow $40k until the special assessment is resolved in order to sell and that any reasonable buyer is going to make her pay the special.

Moral of the story - stay the hell away from HOAs because being in one will give you insight into how stupid and financially irresponsible people are and you don't need to own a common enterprise with morons.

(The lawsuit is part of a long-running dispute in which Ferentz and his wife, Mary, have been portrayed as difficult, stingy and privacy-obsessed, clashing with their image as friendly philanthropists who support the Iowa Children’s Hospital.

A judge ruled in September that the Ferentzes aren’t required to join the homeowners’ association that their neighbors formed in 2015 to share road maintenance costs. That freed the Ferentzes from having to pay a $9,400 assessment for road repairs and dissolved a lien the association obtained on their property to collect payment.

The Iowa Supreme Court recently declined to hear the neighbors’ appeal, setting up trial on remaining claims.

One neighbor has testified that they “bent over backward” to reach agreement with the Ferentzes but were rebuffed repeatedly. The Ferentzes’ attorney has argued that the case is about property rights, saying owners cannot be subjected to restrictions to which they haven’t agreed.

Lawyers for both sides declined to comment for this story

Ferentz has led the Hawkeyes since 1999 and is Iowa’s highest-paid public employee. His contract will pay $5.2 million this year, including a $500,000 bonus for an eight-win season.

The dispute dates to early in Ferentz’s tenure, when his family bought land on the single-lane gravel road.

Neighbors John and Ann Marie Buatti proposed subdividing their 20-acre property for a development that would include a road resurfacing and extension. They wanted space for their children to ride bikes.

Mary Ferentz objected, saying she wanted the road kept gravel and the neighborhood to remain rural for privacy reasons.

“What I remember distinctly is she looked at me and said, ‘No, you don’t understand who I am.’ ... I was a little bit taken back,” John Buatti testified. “For me it was the safety of my children, not who she was or why that would matter.....”)



I don't have a problem with them not wanting to join a HOA. Those things always devolve into a landlord relationship with homeowners. And the reason people buy homes is to get away from landlords.
I do find it interesting Kirk and Mary want a hermetically sealed lifestyle that includes a gravel road. None of us know what Mary is like, but after watching KF for 19 years it's pretty clear he's a phony skilled in the art of fooling rubes.

I read the first line of your post and am replying to that. Who cares what the character of Buatti is. That shouldn't influence the character of KF should it? Many on this board are basing KF's coaching talents on his character.
