Kirk & his neighbors...

Let me see if I can recap this correctly:

1. Kirk & Mary want the road to stay gravel.
2. Neighbors want it paved.
3. Paving cost $9,500
4. Judge ruled that Kirk & Mary don't have to join the HOA despite previously agreeing to join (not sure if written contract was signed)...
5. Neighbors/HOA want Kirk & Mary to pay their portion of $9,500 despite not being part of HOA.

I guess the big question is how or who paid for the road's maintenance prior to this point?

Was it paid/maintained like every other road thru the county or did the Ferentzes and neighbors always pay to have the gravel road maintained?

If it has always gone thru the county, is the HOA even legitimate?

Why is the AP reporting on this and not local Iowa sports journalists?

Also, I’m not Kirk’s hugest fan in the world, but F his neighbors. If I don’t want to join an HOA and a court of law says I don’t have to, you ain’t gettin’ my cash, Jack.

Well, if it goes to court, we'll get all the details. I can't wait!!
 
Just read an article from February 6th that said attorneys for both parties said it had been settled the day before the trial was to take place.
 
I thought they 'settled' this a short while back. What changed?

Iowa coach Kirk Ferentz and his neighbors are headed back to court in their long-running property dispute after a settlement both sides announced in February never came together.

Lawyers told the court last week that the parties have been unable to reach consensus on "certain material terms" needed to execute the settlement.

I think Kurt's share was $9500, which isn't the cost of the whole road. I'd like to see the actual evidence here, but if Kurt and Mar didn't join the HOA, then the HOA is SOL, IMHO.

You are missing a couple key points. When the Ferentz's were initially approached they agreed to help pay for maintenance of the road, AS LONG AS IT STAYED GRAVEL. The key is that they wanted it the way it was to feel more rural and to keep gawkers away.

The radiologist went behind their backs and had some kind of hard surface put down when the Ferentz's were out of town. He also complained that the Ferentz's planted some trees and other landscaping to keep their property hidden to a point.

The radiologist then set this HOA up and tried to force the Ferentz's to join but by now Kirk and Mary are pizzed as hell so said F off radiologist. I actually think the radiologist just wants everybody to pay for the road but his main interest is to get it paved to help sell his lots. He wants to break his property up into lots and sell them. If the road is paved, it is better for him.

The key is that the Ferentz's agreed to help maintain the gravel road, not the paved road. So, this is why they never joined the HOA. I also don't think they are on the hook for the paved road.

From what I've read, the radiologist sounds like a complete tool. I'm glad Kirk and Mary never gave in. I don't care if he is the most paid man in Iowa.
 
I wish i knew how to link an article but anyway an article came out yesterday and stated that the ferentz have landscaping and trees on the easement.
 
If I had Ferentz’s money I guarantee you I’d have no neighbors. I’d buy a section of ground with rural water access nearby and have electric plowed in. Put a house in the middle of it out of view of the road with a gated driveway.

This is hysterical. The US has always been strong about protecting property rights. If the US was the same now as it was 200 plus years ago...what a place.

Any democracy is about change in rules and laws. Each HOA is different with some good and others bad, but that view is oft dependent on which side of a debate you are on. You buy property anywhere close to civilization and the rules are going to change. The metro area is one of the few in the state that is actually showing some growth.

Our whole country is about people with deep pockets trying to change rules for their advantage. It's also about people fighting that, some with altruistic intentions and others with personal gain intention. It happens in families, it happens in Govts and neighborhoods.

In this case you have two opponents with deep pockets with opposing views. Eventually the area will become more developed and things will change.

If I had deep pockets one of the first thing I would change would be to ban Iowa limestone roads like most other states have gone away from. It is an air quality issue. In the US, 67% of particle contaminants in the air are from gravel roads.

Who's talking about a democracy? The US is not a democracy (although one can legitimately argue it has devolved into far worse)
