Does anyone think Kirk will hold him out the first game for something so minuscule and ridiculous? I'd think a talking to and maybe some time doing extra's like community service? Does it being an hour and a half after 10pm come into play?
If you think...First of all, Wirfs could of avoided the whole thing by refusing to identify himself. You have to have reasonable articulable suspicion that a crime has been committed, is being committed, or about to be committed. How could they possibly know TW was 20 yrs. old unless 1.) They have encountered him before, or 2.) They have a list of Iowa players that are underage. Either way it sounds like profiling to me.
If TW refused to ID, they would have to let him go. You only have to ID yourself if and only if you have been arrested for a crime. It is only a secondary charge, not a reason to arrest.
I see the Iowa City ordinance as a violation of your First and Fourteenth Amendments. It violates a persons right to liberty. Liberty is the right to do what you want, go where you want, and say what you want. Underage drinking is a crime. But simply being underage, is not a crime. I’d like to see someone challenge the Constitutional validity of this stupid ordinance.

Again the catfishing thing. As a matter of fact, standing up for your rights is the only way you can be free. It is how you change the world. There are thousands upon thousands of examples out there where the police and municipalities violate citizens rights everyday. If you don’t stand up for your rights then you deserve to lose them. You can be one of the sheep if you want to, but I wasn’t designed that way. I will always stand up for my rights instead of being one of the fucking walking dead out there. “Liberty” is not protected by the 1st amendment. While it certainly is a shitty ordinance, I see no valid constitutional violation here. Liberty is only “violated” in relation to the fourteenth amendment if due process is denied. Wirfs can have his day in court, if he’d like it. This ordinance is pretty clearly within the Iowa City’s police powers (which I would generally argue have been considered far too broad by the Supreme Court, but their is a long history of allowing very broad police powers to the state), just as it is perfectly valid for the state of Iowa to ban alcohol sales before 8:00 am on Sundays.First of all, Wirfs could of avoided the whole thing by refusing to identify himself. Is being suspicious a misdemeanor or a felony? Wirfs was not consuming alcohol. So who is the victim here? Where is the crime? I’m sure most businesses and officers have video cameras these days and the officers better have there facts right or they can face charges of their own. Always video your interactions with the police.See, this is all good and well, but you have obviously never read a police report. They are cut and paste jobs. If the guy refuses to identify himself, the report goes like:
"Officer Hardass and I entered Sports Column at 11:30 as part of an ongoing surveillance operation to curtail underage drinking. During the operation, we witnessed an individual personally known to Officer Hardass to be an individual who was under 21 years of age, hereinafter "Suspect." When approached and asked for an identification to verify compliance with City Ordinance, Suspect became nervous, fidgeted, began scanning the room and made a rapid move toward his waistband, at which point I, and Officer Hardass, pulled our firearms. We both demanded that the suspect show his hands. After giving the Suspect 32 seconds to comply, Suspect produced a black oblong object from his waistband. Fearing for the safety of the patrons in the bar and my own safety, I discharged my firearm 5 times into center mass of Suspect."
The time to challenge the police tactic is when you are not guilty. The cops probably know who the guy is and I'd be surprised if the bar doesn't color code wrist bands based on age to identify who can buy beer, thereby making it very easy for the cops to form reasonable suspicion.
