Regardless of Barta’s remarks, the fact remains that schools are using NIL as a recruitment tool. He actually did reference that concern. I would argue that reigning in NIL should focus on that circumstance. In many ways, the transfer portal has contributed to blatant misuse of NIL. Should players be allowed to use NIL? Yup. That is the law. I have, however, read countless posts on HN berating cheaters in the recruitment world. The transfer portal and NIL have opened a new door for cheaters. That is what needs to be fixed. The red herring in some posts above is the assumption that any restraint on NIL is a direct attack on the rights of players. Well, that argument does not make much sense. Like any innovation, adjustment toward improvement is part of the plan. Right now, the Wizard of Oz is leading the charge on players’ rights while ignoring the “other” elephant in the room.
