If he wasn't drinking (and I assume not, since it doesn't seem a PAULA was issued), this seems like a "we addressed it internally" sort of matter. Sure, he should have known better than to be there, but common sense is applied and Wirfs is told to make better choices and is assigned a little extra time at Steads (win-win for Wirfs and the kids).

The optics of giving him the same penalty for an OWI on one hand, and just sitting in a bar past 10pm 5 months too early on the other hand, would like really bad. I suppose you could take the repeat-offender thing into account, but it either looks like you grossly underpunished him last summer or are going overboard this summer.

I still think common sense will prevail in this instance.

This is just like getting a speeding ticket. He doesn't deserve to be removed from the line-up for something like this. If he was drunk or under the influence I am sure the IC cops would have included that as well and it would have been all over the papers. In this case it doesn't look like that happened so who cares.
