Well that would disqualify LaMichael James too.
At least James is eligible. So is Newton, but that fact will change within the next 5 years.

And if it doesn't? Newton's eligible and is head and shoulders above the rest of the candidates, the only people not voting for him will be attention seeking media whores that just want to get a column and a spot on ESPN out of it.
You're kidding, right? What, in his entire case, leads you to believe that he's innocent? The NCAA already found that he violated his amatuer status, and the investigation is ongoing. More is going to get dug up, and it's not going to end well for him. It won't matter, because he'll already be making millions in the NFL. But if he is never ruled ineligible, I'll buy Notre Dame season tickets.
The voters are well aware that he could easily be ruled ineligible. Just because they don't vote for him doesn't mean they're attention whores. They don't want another Reggie Bush case, especially one that comes up immediately after the Bush case was resolved. Can't say I blame them for that.
Newton is without a doubt the player of the year this year. To vote for anyone else is just throwing away your vote.
1) L. James
2) K. Moore
3) C. Kaepernick
Wondering how Newton's past lack of Integrity (stuff from Florida as well as current investigation) puts him on the same level with Nile? He may win, (mostly because all the votes West of Chicago will be split up) but the trophy is becoming a joke.
