Marion arrested

First of all, Driving While Barred is more than just a simple 'traffic ticket'. It is an aggravated misdemeanor, which means it carries a maximum of 2 years in prison. Now, that's probably not what the outcome of this charge will be, as very few people go to prison for this charge (unless they are totally habitual about committing this offense), but it is a more serious offense than some of you are making it out to be. The real problem is the fact that, Montel has already been kicked off the team once for violating the law and was given a 2nd chance to return by Brands. Brands trusted that he would keep his nose clean, but obviously he hasn't done that. I say Brands boots him - again. Montel has no one to blame but himself.

Yep I am familiar. If he had a license and was pulled over and ticketed for not making a complete at a stop sign do you kick him off the team?

But he wasn't ticketed for a stop sign, he was knowingly driving while barred. That shows a blatant disregard and lack of respect for the law. Combined with his previous issues this will be the easiest decision ever for Brands.
 
I don't think this even becomes a Brands problem, I think Barta and Mims will take it out his hands and Montell can start applying for jobs with all the free time he will have not wrestling and he should have to pay for the second semester of school should he stay. This isn't just about the aggrevated misdemeanor, it's about the 2,3,4,5,6th? time being in trouble with the law or thrown in jail. So, who goes 141 now Ballweg or Dweiza?
 
Gable and Brands have always said everyone at weight had to be ready to go like a starter be it injury, illness or in this case STUPIDITY that takes the starter from the line up. Well, time to go Ballweg or Dwieza!!!
 
So if he would have had a DL and got caught speeding 75 in a 45 would people still think he needed booted off the team? Because this is almost about the same thing. It isn't that big of a deal.

Sure he has had problems in the past, but this isn't close to being anything related and alcohol wasn't involved. I think a lot of you are blowing this way out of proportion.

You can speed accidentally. You don't get a driving while barred as an accident.

Duh, of course it's not the same thing. The law clearly states its not "almost the same thing". One is a simple ticket. The other an aggravated misdemeanor.

again it isn't about the severity of the charge, its about the fact this guy said "**** the rules, I don't have to play by them."

combined w his previous actions this is an easy decision.
 
From what I am hearing it is a technicality. MM had his license back and was ticketed for speeding while on probation. According to what I hear is that the DOT sent him a letter in the mail informing him his license was revoked. MM didn't read the letter or it hadn't showed up at his house yet so he was unware his license had been revoked. I don't think this is a big deal. A simple technicality that MM either didn't read the letter or it hasn't been delivered yet. He should have maybe know that because he was on probation any moving violation results in revoked license.
 
I know some people that were around the night Marion went on a tear in Indianola. Lets just say they didnt see such a good kid that night..
 
The only way I see him not getting booted, is if it is true he was sent a letter and it hadn't arrived (I guessing it may be sent certified?). Otherwise, if he knew he didn't have a license he is gone. I don't think this will even get to Brands to make a decision, if determined Montell knew his license was revoked, Barta and Mims will say clean out your locker.

You can't accidentally speed 30 mph over the limit. And that isn't a simple ticket either it is a serious misdemeanor which isn't much better than an aggravated misdemeanor.

I understand he had to know he didn't have a license but the charge isn't that much worse then speeding 30 mph over the limit and if that would have been the case people wouldn't be calling for him to be booted.

If he is gone then so be it, but if he isn't that is fine as well because I honestly don't think this is a big issue.
 
Per TOS, Andy Hamilton tweeted that Mims says there is no change in Hawkeye status and is just being treated as a traffic violation at this time.
