College Football Suicide Pool--Week 6

I borrowed the idea for a pool like this and i'm running a similar deal with some people from work. What I want to know if how you would decide the winner in the following scenario. Says it's week 10 and only 2 people are left. They both get their picks correct, but one of them is now out of eligible teams to pick from. Is the other person the winner by default as they still have picks left? Or does the other person still need to win in week 11 to be the outright winner? What say you?

I say the last person to correctly pick an eligible team wins. So in your scenario, the person that is out of teams has to hope that the other person picks a losing team in week 11. In the even of a tie, there should probably be some sort of tie-breaker, but for the purposes here, I haven't decided what we'll do. I'll probably come up with something in the next few weeks.
