BREAKING NEWS: Feds to Probe Penn State Over Sex Abuse Scandal

The U.S. Department of Education has announced an investigation into Penn State University's sex offense scandal over the school's compliance with crime disclosure policies.
Penn State's football's former defensive coordinator, Jerry Sandusky, has been accused of molesting eight boys over 15 years.
The investigation -- to be carried out by the Office of Federal Student Aid -- will determine whether the school followed the Jeanne Clery Disclosure of Campus Security Policy and the Campus Crime Statistics Act, read a statement from the Department of Education.
Colleges and universities are required to disclose the number of reported criminal offenses each year on campus under the Campus Crime Statistics Act. Institutions also must issue timely warnings if a reported crime is a threat to the greater campus community, the statement read.
"If these allegations of sexual abuse are true then this is a horrible tragedy for those young boys," said Education Secretary Arne Duncan. "If it turns out that some people at the school knew of the abuse and did nothing or covered it up, that makes it even worse."
Penn State officials were notified of the investigation through a letter. The Office for Civil Rights will assess further investigations or enforcement actions if necessary.
The football team's 84-year-old head coach, Joe Paterno, has taken criticism since Sandusky was charged. Paterno announced Wednesday that he would retire at the end of the season.
Athletic director Tim Curley and vice president Gary Schultz have also been charged with failing to notify authorities after an eyewitness reported a 2002 assault.

Great. So now the mess will really get messy, with Uncle Sugar's greasy hands on it.

They said when they are done with this they will go ahead and fix the BCS. ;)

Hooray for Big Gub!
I think sandusky will probably be offered a job by TSA as a screener. I mean, he's got the credentials.:mad:

Well, if the government is going to get involved things WILL get done! Mostly burning up tax dollars and wasting our time...

What is the recourse if they are in violation of these acts?

I was wondering the same thing. The university is in big trouble. I do feel bad for all the PA tax payers and PSU students who are going to pay the costs of this litigation for years to come.

Who writes these headlines anyway...really "Probe" in a sex abuse scandal...you couldn't just say "investigate".

I have a son who just turned 10 yesterday...I couldn't help but think of what I would feel or do had he been put in the same circumstances as those other children...under the guise of a learned institution and an infamous football program. I find it hard to believe I could contain myself from seeking physical restitution at the hands of those who allowed and covered up this abuse. I'd want to take them all to the ring...even that old fart Paterno. They simply need a good arse kicking.

I'm not a violent man, but this would stretch my ability to contain the anger to just seeing justice done. All you have to do is imagine your child in that situation. These men did nothing.

I realize this situation is anything but funny, but this right here is funny. Only if Mesaclown was still around to defend it would have been better.

Answered my own question: Compliance is monitored by the United States Department of Education, which can impose civil penalties, up to $27,500 per violation, against institutions for each infraction and can suspend institutions from participating in federal student financial aid programs.

VA Tech 55,000 on March 29, 2011 for their failure to issue a timely warning in response to the shootings at West Ambler Johnston.

Eastern Michigan University was fined $357,500 for failing to warn the campus of a student's assault and death that occurred in 2006.

What is the recourse if they are in violation of these acts?

If what I read earlier is correct, this probe is civil in nature, not criminal, so at worst they would get fines and a hit to their reputation. They can afford the former, and I'm not sure how the latter would harm them at this point.

I'm wondering though if a criminal Fed probe isn't far behind.

The fine won't mean much to Penn State but not taking part in federal student aid programs would destroy their enrollment.
