The cops do not have to take you to jail for public intox...it's basically up to them to make that decision. Usually if they think you are at risk to hurt yourself or someone else, they will take you. Did you read the Press Citizen article recently about the kid in Iowa City who got public intox twice in one night? After the first one, the police released him to a friend without taking him to the cop shop...they found him again a couple of hrs later passed out on the side of the street...they took him in the 2nd time.

I've seen it a dozen or more times in Iowa City where the police cite someone for underage drinking and then let them walk out the door.

Its up to them?? Yet I am pretty sure there were over 100 arrests for public intox that night, and they were all riding the elevator with me the next morning. I did read that article and it was on a game day that the article also stated that they don't take people to jail on game days anymore because it would be overcrowded. You need to pay attention to the reason they didnt' take him in.

Bigger question that should be raised here is who appointed them to be the judge and decide? How do you think they decide? Does it matter if your rich? Does it matter if you are the officers son?....................................

I know some here have to be about ready to say it, so go on, make my point for me.

They do not have to take you in for public intox. Gameday or not, they don't have to. 99% of the time if you are being arrested for public intox it's because you are doing something to bring attention to yourself. They could arrest everyone in the ped mall if they wanted to, but they don't. Again, if you are at risk of hurting yourself or someone else, you will go to jail.

They are trained to make the best decisions they can on the spot, just like many other professions. Firemen, soldiers, medics, etc. etc etc. all are trained so that when the time comes they are prepared to make decisions that they think are best for those directly affected by said decisions.

Who are you to question what they do? Just because your brother was an officer does not qualify you to second guess an officer. You are entitled to your "opinion" but to question an officer's motive, is laughable. They deal with violent criminals all the time and they have to be prepared for the worst all the time.

If an officer smells pot coming from a car and the care was pulled over for a violation, I have to side with the officer. The two will have their day in court if they choose to.

Cosign. And when the cops do a search of a car with two occupants, they generally call out for backup so that the cop who is searching isn't opening himself up to violence from the occupants. Now if I were a judge and a motion to suppress came across my bench in which the accused said there was no reefer smell in the car and I had two or three cops saying there was, plus the fact they actually found reefers in the car, I would toss that motion to suppress out very quickly.
 


Well lets see, they work in a public position, paid for with tax dollars, so yes I have every right to question what they do.
I am going to open up a store, I am not going to allow some people into it based on what I feel, I am going to say I had a sixth sence about them ( it was'nt based on ____ I swear). The ones I do let in, some I just wont serve because well, I am a trained bussiness owner and server, based on that I can tell who is hungrier than who. Finally some I am going to charge $10,000 for thier meal, because being the fore mentioned trained person I am, I can tell that they are dressed and drive a car that warrents the excessive cost. Finally the long hair that pulls up in a vw bus, well he must be broke and cant afford a hair cut, and he drives a old van so I think I will bring him in put him at my best table, he will be the first to get served, anything he wants is on the house.
Sounds stupid huh? So if that is illegal for me to do and just plain sounds stupid, how do you justify?
Another thing it was not only my brother, I know 5 officers, I guess you could say they had to much character for the job!
 


I thought it was weird that he wasn't arrested, considering they arrest people for drug paraphernalia all the time. Definitely not an open and shut case. FYI- I don't care either way if he comes back to the team.

Is there a point to this? I can't tell if you are some sort of anarchist or just some prole who has an axe to grind over an 18 year old seatbelt ticket you got in Boone County. I'm not a cop, but if I were and a county attorney told me to lie on the stand I would get a lawyer and contact the State's Attorney and/or US Attorney's Office immediately. But I, unlike your cop friends and family members, believe in the State and Federal Constitutions and wouldn't sit by idly and watch some blow dried college boy stomp on them.

Olddude-You are just ranting about law enforcement in general now. You can do whatever you want with your business, but you wouldn't be in business for long if that's the way you operate.

In this specific case, do you think the police officer targeted these two for a reason? It can't be race because the kid driving was white. I'm not sure what type of vehicle it was, but the southeast side of des moines has plenty of nice cars and clunkers, so I'm not sure why they would pick out one specific vehicle. Is it possible that the officer just pulled them over because he didn't see a license plate on the front of the car when they drove by him?

You obviously have had issues with law enforcement in the past, so now you apparently think all law enforcement is corrupt. God forbid you ever need their help.

You do realize that, with your statement, you have indicated that your brother, possibly your friends, and an attorney from the county attorney's office have conspired to commit a federal crime that could put them in jail for a long, long time?
 


Either way, whether probable cause is used justly or not, I truly believe in karma- and sometimes you have to suffer it's wrath. I live next to a pot head now, I smell it everyday and could easily pass along that to the cops, but I don't even use weed but i am one that believes Mary J is not a harmful drug. Now if I were to turn my neighbor in, in my eyes, that would bring me bad karma. I just think ARob had his comeupance because of karma.

While his example was incredibly stupid, I am quite sure that there were other cues that led the officers to stop that car. DMPD has better things to do then simple stop cars that don't have a front plate. I'm not sure what else may have led them to stop the car (perhaps the car was driving oddly, or they saw smoke, or maybe they recognized the driver, could be the time, etc).

I can tell you with a good amount of certainty, though, that they smelled the pot (or saw it). Searching the car requires another officer to assist (and may even require the patrol sergeant to make the decision). It is not one of those situations that you would want to come up empty - the lawyers would have a field day...
